Minutes of Commission meeting held on November 13, 2012.
7:00 p.m. Chairperson called the meeting to order. The minutes of October 23, 2012 were read and accepted and will be distributed.
Present were: Nathan Gumlaw, Chairperson, Neal Byrne, Patricia Caron, Marianne Martone and James Wettlaufer. Absent: Marcia Beal.

We received from DCR (Department of Conservation and Recreation) a copy of a letter sent to Bernard M. Bergeron of Canadian Tree Expert, Co., Inc. requesting his and his harvesters to attend a hearing at the DCR Amherst Office to discuss the unpermitted timber harvesting and associated Wetlands violations on the Northeast Concept/Huguenot Farm at 174 Mashapaug Rd., Holland, MA.
We received from Opacum Land Trust a letter requesting our support for establishing a new Heritage Corridor Forest Legacy Area but we really need clarification. It was mentioned that Norcross already has a great deal of Forest Land in Holland. Neal Byrne is to investigate.
We received from John Sargent, Project Manager, Regulatory Division of the New England District, Corps of Engineers a copy of a letter sent to Neal Byrne regarding his NOI project, DEP File #184-0283 at 29 Lakeridge Dr. to repair his lakefront wall stating that his project may involve activities that require a permit from the Corps of Engineers. Neal Byrne reported having called Mr. Sargent and discussed his project. Mr. Sargent said he may need to evaluate the project. James Wettlaufer said he will investigate as to why the Army Corps of Engineers is questioning the Conservation Commission decision.
We received a copy of the Receipt from the Hampden County Registry of Deeds of the filing of the Order of Conditions for Neal Byrne’s project, DEP File #184-0283.
7:30 p.m. John Scott showed us pictures of 5 dead trees at 12 Leno Rd. Some were close to the lake and house. He wanted permission to fall a pine tree onto the lakebed. He was informed that no trees can fall onto the resource area. He was instructed to hire an Arborist who would inform him how to proceed.
7:45 p.m. Gerry Tabb of 45 Lakeshore Dr. spoke of his concern of possibly losing the right-of way adjacent to the Ardizzoni property when construction of the house on the Ardizzoni property commences. He was instructed to monitor the site and pursue with a civil action if necessary.
The meeting was adjourned at 8:10 p.m.
